RE: Shoshoni Plains Phase IV-B Plat Amendment
Based on the testimony provided by applicant Clare Rood, it appears there will be no functioning HOA to look after the common areas and CCR’s for the Shoshoni Plains Phase IV-B Amended Subdivision. Given this new information, we recommend the following:
- Public Park Improvements. It appears the Planning & Zoning Commission does not want to renegotiate park improvements. We respect this position.
- HOA Organization. It appears Mr. Rood is not keen on organizing an HOA for Shoshoni Plains. We’ve also received inquiries from an existing Shoshoni Plains resident about the legal options available for nullifying the CCR’s for the entire Shoshoni Plains development. We believe the Planning & Zoning Commission should consider this subdivision application with the expectation that no HOA nor CCRs will govern the subdivision. Anything in the development agreement, conditions of approval, or other governing documents should reflect this.
- Open Space Conveyance. Mr. Rood has proposed that the HOA be responsible for the open space parcels within the subdivision. Given his admission that a functioning HOA is not likely, the Planning & Zoning Commission should require conveyance of these parcels to the City of Driggs. If the city is unable or unwilling to accept the open parcels, we recommend that the subdivision be reconfigured to eliminate them.
